How to Enter: No purchase necessary. The entry period of the Pactimo Storm+ Bib Tight Giveaway ("Contest") runs from 12:00 p.m. MST on October 13, 2023 until 11:59:59 p.m. MST on October 26, 2023 (“Entry Period”). To enter this Contest, users must read and accept the OFFICIAL CONTEST RULES (“Official Rules”), you must follow @pactimo_official (Instagram) or https://www.facebook.com/pactimo/ (Facebook), like the post associated with this promo published by Pactimo and tag 3 people in the comments. The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram and Facebook (the “Social Platforms”). The Social Platforms are hereby completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to the Social Platforms. You may only use one (1) Instagram or Facebook (the “Accounts”) to participate in this Contest.
ELIGIBILITY: To enter and be eligible to win, a person must be a resident of United States, United Kingdom or European Union and over the age 21. Pactimo (the "Sponsor”) and its employees, parent and affiliate companies, their representatives and agents, as well as immediate family members (sponsors, parents, siblings, and children) and the persons with whom they are domiciled are not eligible to enter this Contest.
PRIZE: There will be one (1) prize allocated to one (1) winner from all eligible entries into the contest across the United States, United Kingdom or European Union. Winner will receive a prize consisting of one (1) Storm+ Bib Tight in their size and gender preference (this prize has an approximate value of $199.00).
DRAW AND ODDS: All participants who enter prior to the end of the contest period will be entered into a random draw that will take place on October 27th (“Random Draw Date”) at 12 p.m. in Denver, Colorado to select the potential winner. The odds of being selected as a potential winner of the Prize depends on the number of entries received during the Contest Period.
AWARDING THE PRIZE: Attempts to notify potential winners will be made using Instagram accounts provided at entry. Pactimo will direct message winners within 2 weeks after the draw. Sponsor is not responsible for phone, e-mail or other communication problems of any kind. If, despite reasonable efforts, a potential winner does not respond within 7 days of the first notification attempt (or such shorter time as exigencies may require), or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected.
In the event that the selected entrant cannot be reached and has not responded within 7 days of the Random Draw Date, another entrant will be randomly selected and the process above will be repeated until such time as a winner is declared. If by 11:59 pm MST on October 30th, 2023, no winner has been declared, then the Contest will be closed and no further Prizes will be awarded.
Prize is non-exchangeable, non-refundable, has no cash surrender value and must be accepted as awarded with no substitutions. The Contest Sponsor reserves the right, in their sole discretion, to substitute and/or modify a prize with (a) prize(s) of equal or greater value for any reason. Should a winner be unable to claim his/her prize or prize portion as awarded, his/her rights to that prize or prize portion will be forfeited. All Entries are subject to verification. Pactimo reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to Pactimo) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).
The Contest Sponsor makes no representation nor offers any warranty, express or implied, as to the quality or fitness of any prize awarded in connection with the Contest. Prize winners understand and acknowledge that he or she may not seek reimbursement or pursue any legal or equitable remedy from the Contest Sponsors should a prize fail to be fit for its purpose or is in any way unsatisfactory to a prize winner.
GENERAL RULES: By entering this Contest, each entrant agrees to abide by the Official Contest Rules and the decisions of the Sponsor with respect to all aspects of the Contest, which are final. To the extent permitted by law, the Sponsor accepts no responsibility for loss, damage or claims caused by or resulting from the Contest and/or the Prizes. Without limiting the foregoing, the Sponsor will not be responsible for late, lost, illegible, falsified, or incomplete entries and all such forms are void. By entering, each entrant consents to the use of his/her name, address (city and province/territory) and/or photograph without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor in connection with this Contest. All decisions of the Sponsor shall be final. All entries become the permanent property of the Sponsor and shall not be returned. By entering this Contest, each entrant expressly consents to the Sponsor, their agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering this Contest and in accordance with the Pactimo’s Privacy Policy (available at: https://www.pactimo.com/pages/privacy-policy/ ), unless the entrant otherwise agrees.
In the event of any discrepancy or inconsistency between the terms and conditions of these English Official Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, registration and/or point of sale, television, print or online; the terms and conditions of these English Official Rules shall prevail, govern and control.
JURISDICTION: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of entrants and Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the State of Colorado without giving effect to any choice of law or conflict of laws rules or provisions. All entrants outside of the State of Colorado consent to the jurisdiction and venue of the State of Colorado for any legal claims arising from or relating to the Promotion or these Official Rules.
PRIVACY: By entering this Contest, all entrants consent to the use of their names and city of residence for publicity purposes in all media related to this Contest used by the Sponsor, without payment or compensation.
